Allgemeine Geschäftsbedingungen

(Die nachstehenden AGB enthalten zugleich gesetzliche Informationen zu Ihren Rechten nach den Vorschriften über Verträge im Fernabsatz und im elektronischen Geschäftsverkehr.)

1. Geltungsbereich

Für alle Lieferungen vom "Einzelunternehmen Andreas Prauschke“ an Verbraucher (§ 13 BGB) gelten diese Allgemeinen Geschäftsbedingungen (AGB). Für Unternehmen zu Unternehmen Verkäufen wird auf 4)b) verwiesen.

Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu einem Zwecke abschließt, der weder ihrer gewerblichen noch ihrer selbstständigen beruflichen Tätigkeit zugerechnet werden kann.

2. Vertragspartner

Der Kaufvertrag kommt zustande mit der: [TETRATERMINAL.COM Andreas Prauschke Einzelunternehmen, 61231 Bad Nauheim Brunnenstr. 29 A. Sie erreichen unseren Kundendienst für Fragen, Reklamationen und Beanstandungen  unter der Telefonnummer [06032 9283494] sowie per E-Mail unter [info@tetraterminal.com].

3. Angebot und Vertragsschluss

3.1 Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Bestellung dar. Irrtümer vorbehalten.

3.2 Durch Anklicken des Buttons [kostenpflichtig bestellen] geben Sie eine verbindliche Bestellung der auf der Bestellseite aufgelisteten Waren ab. Der Kaufvertrag kommt zustande, wenn wir Ihre Bestellung durch eine Auftragsbestätigung per E-Mail unmittelbar nach dem Erhalt Ihrer Bestellung annehmen.

4. Widerrufsrecht

4.1 Verbraucher haben das folgende Widerrufsrecht.

Sie können Ihre Vertragserklärung innerhalb von 14 Tagen ohne Angabe von Gründen in Textform (z.B. Brief, Fax, E-Mail) oder – wenn Ihnen die Sache vor Fristablauf überlassen wird – auch durch Rücksendung der Sache widerrufen. Widerrufsfolgen

Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z.B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung sowie Nutzungen (z.B. Gebrauchsvorteile) nicht oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren beziehungsweise herausgeben, müssen Sie uns insoweit Wertersatz leisten. Für die Verschlechterung der Sache und für gezogene Nutzungen müssen Sie Wertersatz nur leisten, soweit die Nutzungen oder die Verschlechterung auf einen Umgang mit der Sache zurückzuführen ist, der über die Prüfung der Eigenschaften und der Funktionsweise hinausgeht. Unter “Prüfung der Eigenschaften und der Funktionsweise” versteht man das Testen und Ausprobieren der jeweiligen Ware, wie es etwa im Ladengeschäft möglich und üblich ist. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Sie haben die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 150 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Andernfalls ist die Rücksendung für Sie kostenfrei. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung oder der Sache, für uns mit deren Empfang.

Das Widerrufsrecht besteht nicht bei Fernabsatzverträgen
- zur Lieferung von Waren, die nach Kundenspezifikation angefertigt werden oder
- eindeutig auf die persönlichen Bedürfnisse zugeschnitten sind wie Funkgerätekonfigurationen oder Firmwareupgrades oder
- die auf Grund ihrer Beschaffenheit nicht für eine Rücksendung geeignet sind oder
- zur Lieferung von Audio- oder Videoaufzeichnungen oder von Software, sofern die gelieferten Datenträger vom Verbraucher entsiegelt worden sind oder die gekaufte Lizenz aktiviert worden ist.

4a. Rücksendekosten bei Ausübung des Widerrufsrechtes

Machen Sie von Ihrem gesetzlichen Widerrufsrecht Gebrauch (siehe Widerrufsbelehrung), haben Sie die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei.

4.b) Die Gewährleistung ist auf ein Jahr nach Erhalt der Ware festgesetzt. ( bei Unternehmen zu Unternehmen Verkäufen). Für Unternehmen zu Verbraucher Verkäufen ist die Gewährleistung zwei Jahre.

5. Preise und Versandkosten

 

5.1 Die auf den Produktseiten genannten Preise enthalten die gesetzliche Mehrwertsteuer und sonstige Preisbestandteile.

6. Lieferung

6.1 Die Lieferung erfolgt innerhalb Deutschland und der EU mit DHL und Tracking Nummer.

6.2 Angaben zu Lieferzeiten finden Sie auf der jeweiligen Produktseite.

Die Lieferzeiten gemäss der AGB durch den Hersteller Airbus belaufen sich auf maximal 12 Wochen. In der Regel erfolgen Lieferungen nach 4-8 Wochen.

7. Zahlung

Die Zahlung erfolgt wahlweise im Vorraus per Banküberweisung oder per Paypal ( zzgl. Paypalkosten).

Der Kauf auf Rechnung ist nach Rücksprache bis zu einem Rechnungsbetrag in Höhe von 1500 EUR möglich. Per Direktverkaufsabtretung an Paypal.
